No provision of this chapter shall be construed to limit the performance of activities of a rabbi, priest, minister, or member of the clergy of any religious denomination or sect, or use of the terms Christian counselor or Christian clinical counselor when the activities are within the scope of the performance of his or her regular or specialized ministerial duties and no compensation is received by him or her, or when such activities are performed, with or without compensation, by a person for or under the auspices or sponsorship, individually or in conjunction with others, of an established and legally cognizable church, denomination, or sect, and when the person rendering service remains accountable to the established authority thereof. 91-429. 1. 19, 20, ch. (7)Once an encumbered license in the licensees home state is restored to good standing, the licensee may obtain a privilege to practice in any remote state if he or she meets the requirements of subsection (1). (2)Adverse action means any administrative, civil, or criminal action authorized by a states laws which is imposed by a licensing board or other authority against a licensed professional counselor, including actions against an individuals license or privilege to practice, such as revocation, suspension, probation, monitoring of the licensee, limitation on the licensees practice, issuance of a cease and desist action, or any other encumbrance on licensure affecting a licensed professional counselors authorization to practice. 2022-63. False, deceptive, or misleading advertising or obtaining a fee or other thing of value on the representation that beneficial results from any treatment will be guaranteed. Any person who holds a masters degree in social work from institutions outside the United States may apply to the department for certification if the academic training in social work has been evaluated as equivalent to a degree from a school accredited by the Council on Social Work Education. This paragraph may not be construed to prohibit that person from retaining his or her own counsel. (3)For purposes of taking adverse action, the home state shall give the same priority and effect to reported conduct received from a member state as it would if the conduct had occurred within the home state. ss. If a revision is challenged, the revision may not take effect without the approval of the commission. (6)If any provision of the compact exceeds the constitutional limits imposed on the legislature of any member state, the provision shall be ineffective to the extent of the conflict with the constitutional provision in question in that member state. (4)Nothing in this compact affects the requirements established by a member state for the issuance of a single state license. There is created within the department the Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling composed of nine members appointed by the Governor and confirmed by the Senate. (e)The commission shall keep minutes that fully and clearly describe all matters discussed in a meeting and shall provide a full and accurate summary of actions taken, and the reasons therefor, including a description of the views expressed. A person registered under this chapter as a clinical social worker intern, marriage and family therapist intern, or mental health counselor intern shall conspicuously display the valid registration issued by the department or a true copy thereof at each location at which the registered intern is completing the experience requirements.
